WHAT OUR PRIVACY NOTICE COVERS

This Privacy Notice applies to personal information collected by Franchise Media Collective LLC through the following websites, programs, events and services, collectively referred to as the “Services”:

Using the FMC websites located at https://www.franchisemediacollective.com, https://www.askfmc.com, https://www.fmcmasteryou.com, and other websites or applications owned or controlled by FMC that link to this Privacy Notice, collectively referred to as the “Sites”;

Applying for, subscribing to or participating in FMC membership plans, programs and benefits;

Using ASK FMC, FMCA or other FMC platforms and services;

Registering for or participating in FMC events, podcasts, interviews, virtual sessions or recorded programs;

Registering for or participating in MASTERYOU programs, including the Transformational Summit and other current or future editions;

Completing applications, registration forms, surveys or payment transactions; or

Communicating with FMC representatives.

Our Sites may contain links to third-party websites. These third-party websites and services are not related to us and may have separate privacy policies and data-collection practices. We are not responsible for these websites or their privacy practices and encourage you to review the privacy policies of websites you visit.

By accessing or using our Services, you acknowledge that you have received and reviewed this Privacy Notice. Your use of particular FMC services or programs may also be governed by applicable membership agreements, terms and conditions, participation terms or other agreements.

If you do not agree with the terms applicable to a particular Service, you should discontinue your use of that Service.

YOUR RIGHTS

You may contact us using the information at the beginning of this Privacy Notice to exercise any privacy rights available to you under applicable law.

Depending on where you live and the laws that apply, you may have the right to request access to personal information we maintain about you, request correction or deletion, receive a portable copy of certain information, restrict or object to certain processing, or withdraw consent where our processing is based on consent.

We may need to verify your identity before completing a request. We will respond within the timeframe required by applicable law. In some circumstances, we may deny or limit a request where permitted by law.

Even when FMC is not legally required to honor a particular request, we may choose to respond to reasonable privacy requests at our discretion.

 

INFORMATION WE COLLECT AND HOW WE COLLECT IT

Generally, you control the amount and type of information that you provide to us when using our website. The data is collected primarily to identify collaboration opportunities, match members for potential partnerships, and optimize the networking experience. All data is processed to create high-impact connections between members or external parties when requested, including information:

  • By which you may be personally identified, such as name, postal address, e-mail address, telephone number, or any other identifier by which you may be contacted online or offline (“personal information”);

  • That is about you but individually does not identify you, such as organization, company, or comments you may provide; and/or

  • About your internet connection, the equipment you use to access our website and usage details.

When Signing up for Services or Mailings

When you register for our services or mailings, we may collect some or all the following information: your name, email address, telephone number, and other personal data.

When Participating in FMC Programs, Events and Recordings

When you participate in FMC membership activities, MASTERYOU programs, podcasts, interviews, recorded video sessions, virtual events, ASK FMC sessions, surveys or other discussions, we may collect information such as your professional background, company, title, experience, interests, relationships, goals, business needs, survey responses, questions, comments, chat messages, voice, image, likeness, recordings, transcripts and participation information.

We may also collect information concerning attendance, session access, engagement and use of program platforms and materials.

 

Chat Software or Contact Forms

Our websites may contain chat software or contact forms that enable members to communicate with us online or offline by email. When you use our chat software or forms, we may collect some or all of the following information: your email address, first name, last name, location, and any other information you willingly choose to give us.

When you enter and use our website and agree to accept cookies, some of these cookies may contain your personal data.

Our Use of Cookies

Our website uses cookies. A cookie is a small piece of data or a text file that is downloaded to your computer or mobile device when you access certain websites. HOW YOUR PERSONAL DATA IS USED AND SHARED

We may provide personal information to trusted third-party developers, contractors, service providers and program partners that help us operate our websites, member platforms, registration systems, surveys, events and programs. These parties may support services such as website hosting, member logins, payment processing, application and registration forms, email communications, electronic signatures, video conferencing, streaming, surveys, analytics, program administration and technical support.

Examples of service providers we may use include Stripe for payment processing, Typeform for forms and registrations, Zoom for online sessions and DocuSign for electronic agreements. These providers receive only the information reasonably necessary to perform their services and are required to protect personal information in accordance with their agreements with us and applicable law.

Some service providers may use their own subcontractors, hosting providers or technology tools to perform services on our behalf. Where applicable, those parties are also subject to appropriate confidentiality, security and data-protection obligations.

For FMC and MASTERYOU programs, we may share participant information with service providers, production partners or operating partners as reasonably necessary to process registrations and payments, administer surveys, provide program access, deliver communications, operate sessions and provide customer support.

For the MASTERYOU: AvA Edition, information submitted through an AvA-related form or survey may also be shared with Sunset Nine LLC, doing business as Assistants vs Agents, solely as necessary to support that edition.

We will not provide participant contact information to speakers, sponsors or other partners for their independent marketing purposes unless this is disclosed to you or you have given permission.

 

Member Interviews, Recordings and ASK FMC

Information that members, guests or participants voluntarily share through FMC podcasts, interviews, recorded video sessions, virtual events, surveys, forms, ASK FMC sessions or other discussions may be recorded, transcribed, summarized and added to FMC’s internal member profiles, CRM, knowledge systems and AI-supported ASK FMC platform.

FMC may use this information to better understand members’ professional experience, interests, relationships, goals, ideas and business needs; identify relevant expertise and resources; and develop introductions, recommendations, collaboration opportunities and other benefits or services for members.

FMC may use artificial intelligence and related technologies to organize, search, summarize and identify potential connections within this information. AI-generated findings or recommendations may be reviewed, corrected or supplemented by FMC personnel before being shared or acted upon.

Publicly released recordings or podcast content may also be used for editorial, promotional, educational, archival and community purposes. Unpublished recordings, transcripts and internal profile information will be used only for authorized FMC purposes, subject to this Privacy Notice and any applicable participation terms.

 

Confidentiality and Data Use Limitations

FMC limits access to personal information to authorized personnel, service providers and partners that reasonably need the information for the purposes described in this Privacy Notice.

We will generally seek your permission before making a direct personal introduction to an external contact unless you have already requested, authorized or reasonably indicated your interest in the introduction.

Information may also be disclosed without additional consent where reasonably necessary to provide requested services, operate FMC programs, comply with legal obligations, protect FMC or others, or as otherwise described in this Privacy Notice.

 

Consent for Networking

Your information may be used to create high-impact solutions by pairing you with other members or external contacts based on your provided preferences and requests. By joining our network and using the Services, you give consent for us to facilitate these connections. If you wish to opt out of this, please contact us using the information at the beginning of this notice.

 

Communications and Emails

We may use the email address you provide to send communications necessary to administer your membership, registration, participation or request for services. These communications may include payment confirmations, access instructions, schedule updates, reminders, security notices and customer-support messages.

Where permitted by law, we may also send you information about FMC membership, events, MASTERYOU programs, services and related offerings. You may unsubscribe from promotional emails at any time by using the unsubscribe link included in the message or by contacting us.

We will not provide your contact information to a partner for that partner’s independent marketing purposes unless this is disclosed to you or you have given permission.

Text Messaging, SMS, Push Notifications, and Telephone Calls

We may use a telephone number you provide to communicate with you about your membership, registration, event participation, customer-support request or other services you have requested.

Where required by law, we will obtain separate consent before sending promotional or automated text messages or calls. Consent to receive promotional communications is not required as a condition of purchasing a membership, event registration or other service unless expressly disclosed.

You may withdraw consent to promotional text messages by following the instructions included in the message or by contacting us. Withdrawal of promotional consent will not prevent us from sending service-related communications where permitted by law.

Community Discussion Boards, Blogs, or Other Mechanisms

Our Services may offer the ability for users to communicate through online community discussion boards, blogs, or other mechanisms. If you choose to post on these discussion mechanisms, you should use care when exposing any personal data, as such information is not protected by our privacy notice nor are we liable if you disclose your personal data through such postings. Also, personal data which you post on our website for publication may be available worldwide on the Internet. We cannot prevent the use or misuse of such information by others.

 

SECURITY OF PERSONAL INFORMATION

FMC uses commercially reasonable administrative, technical and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration or disclosure.

Access to personal information is limited to authorized personnel, contractors and service providers that reasonably need the information for legitimate business purposes.

However, no website, electronic transmission, storage system or security measure can be guaranteed to be completely secure. You should use care when transmitting personal or confidential information electronically.

DATA RETENTION POLICYWe retain personal information for as long as reasonably necessary to provide our services, administer memberships and programs, fulfill the purposes described in this Privacy Notice and comply with legal, accounting, tax and contractual obligations.

The criteria we use to determine retention periods include:

  • The length of our relationship with you;

  • The services, memberships or programs in which you participate;

  • The need to maintain transaction, payment, registration and business records;

  • The continued relevance of information to ASK FMC, member profiles, introductions and member services;

  • Whether recordings or materials continue to be used for authorized educational, editorial, archival or promotional purposes;

  • Security, fraud-prevention and dispute-resolution needs; and

  • Applicable legal or regulatory requirements.

When personal information is no longer reasonably necessary, we may delete it or de-identify it by removing or separating your name and other directly identifying information.

We may retain and use aggregated or de-identified information for analytics, research, service improvement and business planning, provided it does not reasonably identify you.

 

PROTECTING CHILDREN’S PRIVACY

Our website is not designed for use by anyone under the age of 16. We do not knowingly collect personal data from children under the age of 16. If you are a parent or guardian and believe that your child is using our website and they are under the age of 16, please contact us. Before we remove any information, we may ask for proof of identification to prevent malicious removal of account information. If we discover that a child under the age of 16 is accessing our website, we will delete their information within a reasonable period of time. You acknowledge that we do not verify the age of our users nor have any liability to do so.

 

COMMUNICATION CHOICES

You may unsubscribe from promotional emails at any time by using the unsubscribe link included in the message or by contacting us at Privacy@franchisemediacollective.com.

You may withdraw consent to promotional text messages or calls by following the instructions included in the communication or by contacting us.

Even after you opt out of promotional communications, we may continue to send messages reasonably necessary to administer your membership, registration, payment, event participation, account, requested services or customer-support inquiries.

FMC does not sell, rent or trade email addresses for monetary consideration. We will not provide your contact information to another party for that party’s independent marketing purposes unless this is disclosed to you or you have given permission.

 

CALIFORNIA PRIVACY RIGHTS

California law provides certain privacy rights to California residents when a business is subject to the California Consumer Privacy Act, as amended by the California Privacy Rights Act, collectively referred to as the “CCPA.”

Depending on the circumstances and applicable law, California residents may have the right to:

  • Request information about the categories and specific pieces of personal information we have collected about them;

  • Request information about the sources of that information, the purposes for which it is used and the categories of third parties to whom it has been disclosed;

  • Request deletion of personal information, subject to applicable exceptions;

  • Request correction of inaccurate personal information;

  • Opt out of the sale or sharing of personal information, where applicable;

  • Limit certain uses or disclosures of sensitive personal information, where applicable; and

  • Exercise applicable privacy rights without receiving discriminatory or retaliatory treatment.

FMC does not sell personal information in exchange for money.

Certain website analytics, advertising technologies, cookies or similar activities may be considered a “sale” or “sharing” under California law even when no money is exchanged. Where required by applicable law, FMC will provide appropriate notices and methods for exercising applicable opt-out rights.

Sensitive Personal Information

FMC does not use or disclose sensitive personal information for the purpose of inferring characteristics about individuals.

To the extent FMC collects sensitive personal information, it is used only for purposes reasonably necessary to provide requested services, process transactions, maintain security, comply with legal obligations or perform other purposes permitted by applicable law.

We may need to verify your identity before completing a request. This may require us to match information you provide with information we maintain about you. Information provided for verification will be used only to verify and respond to the request.

You may authorize an agent to submit a request on your behalf. We may require evidence that the agent has been authorized to act for you and may also require you to verify your identity directly with us.

Some requests may be denied or limited where permitted by applicable law, including when information must be retained to complete a transaction, provide a requested service, comply with a legal obligation, maintain security, prevent fraud or establish or defend legal claims.

Even when FMC is not legally required to honor a particular request, we may choose to respond to reasonable privacy requests at our discretion.

Non-Discrimination

FMC will not unlawfully discriminate against you for exercising an applicable privacy right.

We may update this Privacy Notice from time to time to reflect changes in our services, programs, technology, data practices or legal obligations.

 

When we update this Privacy Notice, we will post the revised version on our website and update the “Updated” date and version number at the beginning of the notice.

If we make a material change to how we use or disclose personal information, we may provide additional notice through email, our websites or another appropriate method where required by law.

Your continued use of our websites, programs and services after an updated Privacy Notice becomes effective indicates your acknowledgment of the updated notice, subject to applicable law.
